H1B Visa Transfer to another Company as Cap Exempt Petition - Did not Travel to US?

Hi

Please analyse the following case.

  1. H1B stamping expiry date is 31st October 2017.
  2. Still working at India, have not travelled to US in H1B Visa(No SSN number).

Is it possible to transfer the H1B to another company as cap exempt petition and travel?

This is a slightly grey area. But, in your case, yes, as you had H1B stamping, you were given H1B status at least once, so you should be able to get H1B transfer done as cap exempt.
