My spouse’s H1B petition was picked in lottery in 2012. Petition was approved with Consular processing (change of status from L2 to H1 was denied).
Spouse is currently on H4 status and has H4 EAD. H1 petition was never used since 2012. How long will that petition be valid to recapture? Can an unused H1B be activated after more than 6 years?
