H1B transfer

hi ,

I have a H1B with a small employer A (~60 employees). I am working on a contract basis with a client.

I got an offer from another employer B for a Full time. If i accept the offer and if my Visa Transfer is approved.

And in later point of time if i do not join new Employer B and if i continue with Employer A. Will there be any issue for not joining B?

Thanks

Hi Srinivas,

The h1b visa is linked to your employer, so when you accept the job offer from employer B your visa is transferred to that employer. Now your visa is legally held by that company and you have to work for them.

If you choose not to work for employer B but want to continue working with current employer A, you will have to get your h1b transferred back to employer A

Assuming you are leaving employer A without letting them know, once you ask them to re-transfer your visa to them - they will come to know which can spoil your situation with them.

Choose carefully - once your visa is transferred, legally you have to work for that employer only.

Thanks for your reply.

I was under the assumption that if i do not resign my current employer A, i can contunie with the same employer A as if nothing happend, even after Petition from Employer B is approved. Correct me if i am worng.

Thanks
