H1B Transfer to US based company while in India (Not traveled before to US)

Hello,

I have a H1B visa valid till Sept 2014 from Company A. The H1B petition was approved on Jan 2012. Due to some issues, i could not travel to US and later i left company A who had sponsered my H1B.

Currently i am working in company B for a US client (say company C) in India. My direct client (company C) has an opening for my skills in US and want me to join them. I have discussed with current employer (company B) and they are OK to let me go and join Company C (US based) .

  1. Is it possible for my client (Company C) to get my unused H1B transferred to them ?

  2. If yes, then how should they file H1B petition ? Will it be H1B transfer petition or H1B cap exempt petition ? Is there a difference between the two ?

  3. Literally how much time will it take to get the petition approval notice ? Do i have to go for the stamping again and how soon can i travel ?

Kiindly request someone to please address these questions …

  1. U must hav worked in US for transfer, which needs previous paystubs n all

  3. Same as normal H1. Go for Premium Processing for quick turn around. U must go for stamping too
