H1B Transfer - RFE , willing to transfer to another Employer

Hi,

I had Approved H1B with Company A , I94 and visa validity till 31st Dec 2014. Company A filed my extension but before we get decision on that , i got my H1B Transfer initiated on 31st Dec 2014. I got the Receipt Number by 5th Jan 2015, and then i resigned from Company A and started working for Company B. Meanwhile i received RFE for my Visa Transfer Application. My current Employer B is not responding to RFE till now. Everytime he says we will do it at the earliest. I am pissed off hearing the same response. I got fulltime opportunity with Company C with a good offer too. But not sure how will i proceed for H1B Transfer.

Is there any way out for this. I am repenting on my decision to join Company B , and so desperately willing to join other good companies who are making me a good offer.

Or is it just dependent on my Company B to file RFE Response and me waiting for the Approved Petition?

“I am pissed off hearing the same response”

Language Language Language… please…

“Is there any way out for this. I am repenting on my decision to join Company B , and so desperately willing to join other good companies who are making me a good offer.”

Why you are worried? There is no problem at all in your situation. The problem is in YOUR UNDERSTANDING of YOUR current situation.

Each of your H1B transfers ARE INDEPENDENT. You can have any number of H1B petitions(or transfers) going at a given point of time.

Dont worry, pl proceed with your best offer/employer.

Good luck

Hi,

Thanks for your response. Just clarifying that i am having an expired visa and I94 , and the approved petition with my previous Employer A is also Expired.
I switched to Employer B once i received the Receipt Number for Visa Transfer.
I am having RFE as a current status for my visa transfer application.

Will this be still possible for me to get my H1B transferred to third Company C ?
If yes, what all visa supporting documents i can provide them for processing my H1B transfer?
As i have an Expired Petition, and the current request for visa transfer is also in process and in RFE.

Technically, you will be out of status during your end date of Employer A and joining date of Employer C, only when your Employer B’s filed H1 petition is finally rejected or withdrawn.
Also there is a recent relief of 60 days grace period ONLY if your VALID H1 employer(in your current case, its Employer A) TERMINATES your job(not by any other means like you have resigned or left them.).
