H1b transfer petition without academic evaluation certificate

Hi,

I resigned from employer A and waiting for employer B to file my Visa transfer petition. I didn’t receive the academic evaluation certificate from employer A. Employer B is going to submit my petition without the academic evaluation certificate. Please let me know if any issues will come in my petition approval

Well, it is hard to say…it depends on many things like Job, your profile. They may issue an RFE, if they need more info…

If they issue an RFE, can I stay in USA till it’s approval or rejection. Already 30 days I’m here after my resignation from employer A

Yes, you can stay until the decision. Discuss with your attorney as well.

Few more doubts,1) if RFE comes, can I continue working with employee B with the petition receipt number.
2) If RFE comes, can I stay in USA for more than 60 days grace period (my last working day with employer A was 20 days back)

RFE is not a denial, you may continue to work until the decision. Your grace period only applies for layoffs. Read H1B Grace Period 60 days rule Check with your attorney and act accordingly.
