H1b Transfer denied Old H1 petition revoked - what are my options ?

  1. I have entered US on 30-Nov-2016 through an approved, stamped H1b petition on Employer A

  2. On 06/21/2017, a new H1b transfer has filed for me to join a new employer B

  3. On 08/14/2017, I have left Employer A and Joined employer B while the receipt is still in process and not approved.

  4. On 22 Sep 2017, Old employer A have revoked my H1 petition with USCIS as i have left them.

  5. On 11/28/2017, My H1b transfer petition is denied and i am still waiting for my denial notice to see the reasons for denial.

Can you please clarify below points:

  1. Am i considered Out of status now ?

  2. How long do i have to leave the US in case required ? When do the grace period start. On day of revocation or on day of denial notice ?

  3. If I want to re-enter US, can a new H1 petition be cap-exempt or should i go through cap again ?

Im in same boat. Why you left the country? Is your I-94 has expired?

Did you file for another H1b with same company or another one?

If you could stop working, was it ok for you to stay in US? I am sure you must have discussed this option with your immigration lawyer or employer, hence asking.

Do not say you are in a bad situation. The situation is bad when we think its bad. You have so many things, and for them you should be thankful. I am in usa, working on receipt, in middle of H1b transfer case, my last h1b is expired on sep 30, got an RFE, gave reply to it already, and now waiting for denial or approval.
I wrote denial first here coz if it results in denial, it will be ok, I am sure I will have something to do back in Karachi :slight_smile: So, be positive and do not listen to negative ppl. Hang in there and i am sure life will surprise you :wink:

I am in same situation.
H1B valid with Employer A until sep 2020 and revoked in Jun 2018, filed transfer to Employer B on April 2018 and it got denied on Nov 27 2018, Filed transfer to Employer C(In house) on Dec 3 2018. Then got job with client from Employer C and filed H1B Amendment so received RFE today.

RFE: Employer relationships, if old H1b Revoked then how come transfer filed?

what are my possible options if current H1B Amendment denied ? Can I file another amendment from Employer C and continue to work?
