I changed company and started working on receipt. From my previous company, I have I94 valid till June 2020 but they withdrew the petition on April 2019. I got an RFE during H1 Transfer and then my H1 Transfer was denied yesterday. As per Company’s Lawyer, my previous I 94 might still be valid from previous company and that I get a 60 days grace period before which I can file a new transfer.
Is the above statement correct ? And what are my options now.
This is slightly grey area. The reason is, you are not employed with previous company and they withdrew it. So, technically, your entire H1B status is governed by current company’s petition. If your previous company has not withdrawn the petition, there may be an option to activate the H1B again, you need to discuss with your previous employer on this and a good attorney. Technically, you do not get any grace period for the second denial as it was decision and not layoff. Discuss with a third party attorney and get second opinion…It is tricky situation.
