I have a H1B with Comp A, starting Oct 1 2016, i never worked for Comp A since there were no projects - still on bench with no pay.

Now if i switch back to H4 will my H1B still be out of CAP?

Can i move back to H4 and keep looking jobs and when i find one move back to H1B?

Is it ok to file a change of status back to H4 from US?

Any help is greatly appreciated.

My employer wants to revoke my h1 from OCT 1st itself since he never put me on a project and never paid me. Will I be considered out of status till my COS is approved?

apply for your H4 visa right away, you will be considered in-status while your H4 is pending for approval, you will be safe
