H1B Stamping Issue

My H1B was approved in 2023, but I haven’t gone for stamping yet. Due to recent changes, I no longer qualify for Dropbox and need to schedule an interview.

My company is small, with only four employees working remotely, and we don’t have a physical office. We have listed my employer’s home address on all documentation and changed the address on the business license also. Initially, when I filed my H1B, my work location was a physical office, but since the company moved to a fully remote setup, I updated my LCA to reflect my home address as my work location. My attorney advised that no amendment was required since my home address is in the same MSA (Metropolitan Statistical Area).

I have been working legally for this company for five years, earning a six-figure salary, and I have all the necessary documentation. It is a product based company operational from last 33 years.

Is it going to be issue in the stamping process since I work for small company, remotely.
Also, on my I797 and LCA company address is different. My Lawyer did not ask me to make amendment to my H1B application since it is in the same MSA.

Also, my company is a product based company so what should I say for the very famous question inhouse project or client project?
We develop our product on our own and sell it to our clients.
I don’t have any interaction with our clients and I get paid using my company.

I’m really worried for the stamping. Currently I’m in USA and trying to schedule a stamping appoitnment.

Is it too big risk to go for the stamping in my Case?

Typically this should not create any issue as the address is in same MSA. DOL cares much more about the address to make sure your salary is equal or higher than the prevailing wages.

Tell the facts to the consular officer if they ask.

In my opinion every case has some amount of risk, not just yours. As far as your employment meets H1B terms, there is no need to worry.
