H1B selection under new rules for 2027

As per the new rules, H1B selection will be based on the wage that is payable by the sponsoring employer to the H1B applicant. If the sponsor wishes to bring a worker from outside the USA, then they have to pay $100000. It is a general estimation that no sponsor will pay $100000 in addition to paying the highest wage applicable for category 4 selection. It is also clarified that payment of $100000 is not applicable for those already in the USA. If sponsors prefer to file petitions under category 4, to the OPT category people, then what Govt can do on that? This is subject to condition, that native people do not show interest to work for a such wage levels, under category 4. Existing H1Bs continue to work , for the remaining period leftover under the existing visa , extension of visa for a further period as per rules, and those who are holding I-140, continue to work, unless they are shunted out by their employers.

So, the next step Govt is expected to do is , non-extension of H1B Visas, to suffocate the concerned, forcing them to leave the country.
