H1B role amendment in progress; so H1B transfer can be initiated in parallel

Hi,

My current employer recently file the H1B role amendment (for the same client). Now I got a very good opportunity with another employer. My question is can my new employer file H1b transfer request, even though my role-amendment is in progress.

I assume you are outside US. Yes, you can get cap-exempt filed through another employer while amendment is pending.

I am in the US, and I am in dilemma what to do. My role-amendment is in progress and I have a good opportunity offer for me.

Trying to get feedback from everyone. I have read some post in this forum that few people have got RFE if in parallel they have any other amendment in progress .

As long as you are maintaining status, I don’t think it should be an issue. Your new employer can submit recent payslips, copy of old approval notice and copy of amendment notice for this. As always, discuss the case w/ new attorney and they would know what is needed to be done and the risk involved.
