H1b rfe - rejection

Hello,

I am currently in USA traveled on H1B with Employer B on May 2018. My H1B Visa is due for extension on May 31 2019 and in between working for different client with Employer B only and amendment and extension filed on Nov 24th 2019. RFE received and responded on April 24th and awaiting H1B amendment and extension approval. My current H1b Visa expires on May 31 2019.

I also have a H1B petition approved from Employer A in 2008 and not used and current status shows approved but I don’t have petition copy with me.

Clarifications:

  1. If my current H1B with Employer B filed for extension and amendment gets rejected, can I use H1B petition approved in 2008 ( I only have petition number but don’t have petition copy).
  2. If yes please let me know how can I get petition copy from USICS.

  1. As long as you have H1B approved once, you can file a cap exempt petition. it does not matter, even if your current H1B amendment gets denied. You can file for transfer with any employer.
  2. Well, the petition is employer’s, you can raise aFOIA Request with USCIS to get the details.
