H1B revoked 3 years back. Can I re-file for under H1B cap-exempt?

I got an H1B visa in 2010 and held the status for a month - Oct 2010 to Nov 2010, after which I went back to India due to some personal commitments. My company revoked my H1B soon after.

Fast forward [b]three[/b] years - Dec 2013, I moved to the USA on an H4 visa. I've got an offer from another company who is willing to sponsor my H1B visa. I want to know if I can use my previous petition and file a [b]cap-exempt H1B visa[/b] OR can I get a H1B  visa [b]transfer[/b]?



Please let me know what my options are.

U are Cap-Exempt. Cap-Exempt is till 6 years from Aproval date… Petitions Approved in 2008 or later are Cap-Exempted for now… As ur petition is approved n 2010, u are Cap-Exempt. A Petition is Cap-Exempt irrespective of whether it is REVOKED/WITHDRAWN
