H1B Revoke / Cancellation and then Transfer

Hi,

I am currently in US and plan to quit my company and go back to India. My current company will send a notification to USCIS and will withdraw the application (revoked/invalid) after my last day.

My question is can the new comapny I plan to join transfer my visa even after above steps by current company i.e. after revoking petition, etc. …

Please guide.

The new employer will have to file a cap-exempt petition for you. They will need copy of old approval notice, or at least the receipt number for this. This can be done successfully even after the previous employer has withdrawn the petition.
