H1b Query - I-140 approved long time ago

Myself and My family stayed in US for almost 5.5 Years on H1B.

My employer has cancelled my H1B on 31 Aug 2018. We have returned back to India on 04 Sep 2018 from US.

My I140 was approved 4 years back.

Can I reapply based on I140 approval? Pl. advise if this creates a problem for me and my family to come back again to US on H1B Visa.

If your I-140 was approved for more than 180 days and not withdrawn by your employer and if it was filed after Jan 2107, then you can do it. Read Official Rule on Federal Register
