H1B Petition transfer from company A to Company B

Hi,
My H1B petition was approved from company A on October 2020.
My I797 Document validity is from 10-October-2020 to 30-September-2023.
After requesting multiple times also, Company A did not send me for Visa Stamping.
So I moved out from company A on October 2021.

From October 2021 I am working for Company B.
Below are my questions:

  1. Company B can again file a new petition on the same H1B picked at company A ?
  2. What is the possibility of rejection for the new petition done by Company B?
  3. What is the best time to new petition from Company B(In which month?) ?

Yes, they can file cap-exempt H1B petition based on previously approved H1B.

Chances are high for approval provided the job offer is legit, your employer is able to pay the H1B wages and your skills and education is inline with the job role.

2023(Just before 3 months of validity expires) ?

2Q: If I apply new petition in June 2023, how may months it will take to petition approval and visa
stamping? (I mean, are the 3 months enough for petition approval and stamping?)

3Q: When I approached a consultancy for visa processing they are charging 2Lakhs rupees + 20%
amount from my salary for 2 years. Can we trust the consultancy?

You can apply any time, doesn’t have to be within the expiry of current I-797 if you are not in the US.

Your employer can file with premium processing that can be approved in 15 days.

That is fishy , I wont trust such a company.

The current status of new petition is "Case is being actively reviewed by USCIS "
My Question: how many days it will take to get the petition approved?

If transfer is applied using premium processing then it will take 15 business days otherwise you need to check processing time for the USCIS center processing your application.
