H1B Petition Approved, Employer not providing petition copy

Hi,

I resigned my company last year & came to US on H4 Visa. I had my H1B petition approved with my employer(Approved from Nov 2012 till Nov 2013), I had not gone for stamping. So I do not know my Petition Number or Receipt Number. My H1B is eligible for CAP EXEMPT. I wanted to transfer my H4 to H1 using my approved Petition Number. But my employer is refused to share petition copy or receipt number with me. Is there any other way to get my Petition Copy?

Thank you so much for your response. I only have my LCA copy. I do not have receipt number. With this,

  1. Can immigration Attorney get the records from USCIS?
  2. How long will it take approximately to get the records?
  3. How long will it take to get H1b by CAP EXEMPT?
