H1B Petition Approved but Visa Not Stamped

Hi,

My Brothers H1 Petition approved this year but his employer is not arranging for the interview.

He is currently in India.Please suggest what he should do next and the possible way of coming to u.s.

How many years the petition will be valid?Please Advice.

As per my understanding, if the current employer is not interested to proceed with the next step he will have to find a new employer who is ready to offer a job and process a new H1B petition.

Petition validity varies from case to case. Generally its for 3 years or the requested end date in the application. You could find the validity date/period in the notice of approval.

I have a query for this case.

  1. My H1B visa is stamped.

  2. I applied for H1b amendment and petition is approved, and I didn’t do stamping due to lack of project.

  3. I have to now apply for new Petition?

Q. Can we go with another petition(see step 3) without stamping the previous approved petition (see step2)?

Please help me on this query?
