My h1b petition is approved and not stamped while I was in India . Mean while , I moved UK and became British citizen . Can I apply the capexmpt for the same h1b with British passport .
I dont think change of citizenship will make you ineligible to apply under cap-exempt but as your H1B was never activated via stamping or working for the sponsoring employer, it will be at USCIS discretion to approve or deny under cap-exempt.
