H1B period after 2 separate L1 stay 14 months apart

Hi All,

I'm trying to figure the time left on my H1b and any help on this would be highly appreciated. 

 

Here is my scenario

1) Entered USA in Aug 2007 on a L1 visa 

2) Exit from USA in Aug 2009

3) Re-entered USA in Nov 2010 on a separate/different L1 visa but for the same employer. So, I entered almost after 14 months (more than 365 days)

4) Applied H1B for 2014 Cap with a different employer and got it approved till Jan 2015

 

 

So, my questions

1) Could the time I spend outside USA from Aug 2009 and Nov 2010 (almost 14 months) be considered as H1B clock reset and I can apply for H1B extend after Jan 2015?

2) Or Any time I spent on L1 which is almost 4 year 10 months will be considered and I would reach 6 years after I spend 1 year 4 months on H1B i.e Jan 2015?

 

Any information and suggestion will help me.

The clock reset happened as you entered on a new L-1 visa. This means time spent b/w 2007 and 2009 is not counted. So you can go for H-1 extension until you have reached 6 years inside US on H-1 and L-1 post Nov 2010.
