I filed my H1 b in May 2012. i got RFE and it showing pending. My OPT Expiring in May 2013. 1) Can i file another H1 does my cap gap will be counted. 2) if continue pending can i work after May 31. 3) Does it come under cap gap period for the pending one.

I don't think you need to file a fresh H1B as long as the result's still pending from your last one.
