I am in peculiar situation. As we know, this year we can get multiple application filed for lottery.
My current opt expires on 15-April-2020.
My current Employer A, will submit e-registration.
I have an offer from Employer B to join them and they can also file H1b for me.
If I go ahead and get two application filed(they are different un-related employer and roles are different as well)
How the dates will work out.
I will come to know results on 01-April.
- If My Employer B’s H1B is picked, I will resign from Employer A(give them 2 weeks notice) and Join B on say 14-15 April(but my OPT authorization will expire on the same date) Do I get cap gap in this situation?
- If My Employer A’s H1B is picked, I will continue with Employer A. I think I will get Cap gap for Employer A.
- If both A and B is picked, I will resign from Employer A(give them 2 weeks notice) and Join B on say 14-15 April(but my OPT authorization will expire on the same date) Do I get cap gap in this situation?
- if None are picked, I will continue with Employer A till end of my OPT.
What happens in case 1 and 3, what happens to Cap Gap? When my H1B is picked for Employer B, Do I need to show any payslips, work I am doing etc.
