My wife is on a 60 day grace period as she lost her job. I am on H4 along with my kids. We traveled to India and now need to come back. Should we be okay? or should be wait until my wife gets a receipt from her new employer? She found a new job and they applied for the paperwork.
I would suggest waiting till she get the receipt. Ask her to email you the copy of receipt, employment verification letter ( start date, position, salary etc) from new employer and last three pay stubs , even if they are from past employer, and carry the hard copy of all of them along with other H4 documents to present to the immigration officer if they ask for.
Hopefully all of you have valid H4 visa already.
