H1B got picked and approved - Withdrawn by employer. Am I eligible for cap exempt

Hello. Here is my situation.

My H1B got picked and approved in June. My employer terminated me in May. They are going to withdraw my petition before Oct 1. My question is:

  1. My OPT status won’t get affected?
  2. Am I eligible for cap-exempt in the next lottery? Will I have to go through the lottery again or my new employer can use my existing approved H1b petition?

  1. It will not impact OPT.
  2. Well, you would not be counted for cap as you have not got H1B status yet and they are withdrawing before the start date, which is October 1st. You need to go through lottery again.
