H1B extn denied, employer willing to apply new H1B.

Hello Sir,

  1.   My H1B Visa extension is denied on (01-15-2014) and my employer willing to apply new H1B in premium immediately (waiting for LCA approval). Is there chance to get my new H1B approval with I94?   My current I94 is expired already (Aug 31, 2013).

  2.    How long I can stay US after denial? The out of status stay duration starts the day denial status update in the website OR the day Attorney got denial notice in mail?.

We yet to receive denial notice from USCIS.
