H1b Extension denied . Cool off period for Cap Exempt application

When H1 Extension gets denied and there are still 3 out of the 6 years left , is there a cool off period between denial and new application under Cap-Exempt ?

There is no cool-off period. If your I-94 is still valid, you can go for cap exempt category

Thanks. But My I 94 has expired. I applied for extension before it could expire
