My Fresh H1B got denied on 21st November. ( RFE - AUg 14 and RFE RR - Nov 6 and Decision - Nov 21). My employer has not submiited enough document requested by USCIS for RFE. Mostly, they have requested for PO's and SOW's and it is In-House based. Also Employer has PO till this December end.
But Now emplyer says that we can show other client PO's which has long term visibility close to 3 years.
1. Will it be considered for Appeal?..2. Can we go for appeal?. If yes, what is the durattion it will take? and what is the probablity to succeed?.
If anyone faced the same situation, please share your expereince.

Mine was also same situation ,Unless your H1approved we can’t change employer ,if you want to appeal your existing employer can only do this, mine was already appealed its under initial review but the chances of approval is very less.
my employer appealed my case and he sent me a Form I-797C notice of action which was received from USCIS but it has another EAC no, if I use my old EAC no it shown like USCIS is cannot provide you with information for your case. Please contact the NCSC 1 (800) 375-5283 for additional information and if I will use my new EAC no it shows like On October 29, 2013, we transferred your I290B, NOTICE OF APPEAL TO THE COMMISSIONER, to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed. If you move, please use our Change of Address online tool to update your case with your new address.i think my case was not reopened that is why very few chances of getting approved,
i also have the same situation, got RFE and my consultant replied but it got denied on 28th Nov, thinking to go for appeal. can anyone tell me what is the success rate?
