H1B denied after initial RFE - Regulatory affairs Specialist -

Hi,

I got a denial on 05/20/2013 for my H1b petition.

we received an RFE for a Regulatory Affaris Specialist position where they stated it is not required to have a bachelor’s degree to perform the duties mention under the job details.

I have a Bachelors in Pharmacy and a Masters in REgulatory affaris from US accredited university

How much time i have to respond to this

How can i defend my self and what kind of MTR we should file?

How did you reply to the RFE? I am also in a non-STEM major (Public Relations Specialist), which is usually harder to justify in terms of degree neccessity. So my attorney made sure that my job description was as detailed as possible (two pages long), describing specific projects with budgets I am responsible for. We tried to make sure that the job duties require theoretical knowledge that only a degree can give you, but options are limited within our jobs. I don’t have a decision yet (still in Initial Review) so I don’t know if mine will be approved or denied, either.

Also, the FLC data center for Regulatory Affairs Specialist doesn’t specify a degree requirement, so that’s not good. USCIS is very strict in terms of that.

I have gone through similar situation recently,received RFE and my H1b visa was denied stating that Bachelor’s degree is not required for the job role that I was performing.

I see many successful Regulatory Affairs Specialist positions are getting approvals, do you have a Master’s degree? did your Employer and Attorney mentioned detailed job duties, you know any similar cases denying H1bs for Regulatory Affairs Specialists on the basis of Specialty occupation
