Hello team, I have a tricky question. I’m seriously considering an option with changing to Premium processing for my H1B visa application. I read before that both a company or an employee can pay the fee, but recently I learned that only company can submit the I-907 form to file for premium processing. How does that work? I’m pretty sure my company wouldn’t agree to pay, so I’m the only option. Also, I learned that an employer may also be eligible to file for premium processing electronically. How can we figure out whether we may or may not do that? Thanks, Olga.
In the books of law, H1B and anything related to it (including premium processing etc) is owned by the employer who is filing it. Thus, your employer is responsible to make a decision on your Premium processing by paying the cost. You cant decide that you want to go for premium processing.

Yes, that’s correct. It is your employer who will have to expedite on your behalf, even if you pay for it. Check the H1B Advisory Tool by DOL , it has that information regarding premium processing
Kumar I looked at the information provided by DOL and USCIS regarding Premium Processing and I’ve got an impression that payment by beneficiary is considered as something unusual, even suspicious… Am I wrong? Well, it could be perceived so…If you have a valid reason, you can pursue…You may work with your employer and look at alternatives, but again, they would also need to document it somewhere why they deduced, so it would be captured somewhere…If you have a proper justification, why not…
