H1B Cap exemption

Hi Kumar,

I was on H1B from 2015 till 2019 and used my 4.8 years of H1B and due to extension denial I had to return to India. I got my 140 approved as well after coming back to India as well.

So my questions are

  1. Am I eligible for H1B cap exemption from same employer now that I’m in India for more than 1 year and also I passed 6 years from first Visa stamping

  2. Can I change to new employer in India and they can file H1B cap exemption, if allowed what are the odds of such approvals

  3. I can be with same employer in India but find if any consultancy can file H1B transfer from US, is that allowed? ( more of a second question so guess)
