Hi,

I received H1B in the year 2010 and stayed in US for 1 year and 2 months.later in 2013, i got L1B visa since then i have been in US in L1B

aaccording to cap exempt law, unused part of my H1B visa is 4 year 8 months , if i claim now how much time i will get to stay in US in H1B ( the time period which iam staying in L1B will also be calculated or not , )

Please let me know your views on the same. Has anybody being in this situation before? I would be grateful for your response.

You can stay a total of 6 years (if GC is not in process). Both stays on H1 and L1 are counted

it doesn’t make any difference in your case unless GC is in process, so go for it ASAP
