H1B Cap- Exempt: unused H1B petition

I had my H1B approved on 2007 till sep 2010 and I entered US in oct 2007 and came back to india on sep 2010.

After entering india I went for visa extension and got it until 30 sep 2011 and which I have not used until now, now I want to use this .

  1. Do I come under cap exempt?

  2. If I come under cap exempt , can i transfer my h1 to another employer? If yes what will be the fee for this?

U are not Cap-Exempt. Exemption is till 6 years from approval and it expired last year
