H1B Cap Exempt to Revove previous stamped visa

I had stamped my H1B visa and it was valid from 2013 to 2017, but never got chance to US.

In between i left employer and they revoked my visa in 2015.

Now i joined same employer in Jan- 2019,
My question are :-

  1. Do i need to apply for fresh H1B application for 2020 years and it will Cap-exempt?
  2. Do i need to use expire visa to extension purpose?

Could any one please help me.

It is slightly grey area.
But, looking at your situation, you would be eligible for Cap Exempt as you had H1B stamping at least once and you were granted h1B status.
You can use your H1B approval, visa stamping for applying as cap exempt. Discuss with attorney.
