H1b - Back wages to prove in status

Hi all,

I was furloughed by my company 5 months ago (I now know are the problems with this and don’t need that explained to me).

I am wondering if my employer paid my back wages in a lump sum, would that be sufficient to prove that I was in status for a new H1b petition (to switch to a new employer)? Also, if the lump sum only paid to the the minimum salary on the LCA and not my full salary as put in the original petition, would that cause a problem.

I guess my question boils down to: are there any rules about the frequency or regularity that salary has to be paid?

Thanks in advance,
Kyle
