I am currently on 12 months OPT period which ends on Dec 13th, 2016. In April this year, my company filed for H1b, I received an RFE, replied but USCIS rejected my H1b case in September. In October, my company filed for an appeal to reconsider my case. This time, USCIS approved my H1b with Nov 4 as start date. Everything worked out well.
But here is the problem. When my H1b case got rejected earlier, my company also advised me to file for an OPT STEM extension for 24 months as the chances of getting a positive result in h1b appeal are rare. So, I applied for STEM extension in October for the period Dec, 2016 - Dec 2018 (24 months). My STEM extension case is still under process with USCIS. What should I do with the opt extension, now that I have a valid H1b? If I don’t do anything, would it affect my h1b status in case a) STEM extension is approved b) STEM extension is rejected? Please advise.
