H1B approval with consular processing

Hello,

Recently my H1 got approved for consular processing with a new employer. I am currently in India. However, I have a valid h1b visa stamp from my previous employer till next year end. Do i need to go for visa stamping again or can I use my previous visa and new I797B and travel to US without having to go to consulate for stamping again?

There is lot of divided opinion on this.

Can someone with a good knowledge on immigration or who went through similar experience please respond to this please?

You may use your valid H1B visa to travel to rhe US and join the new employer, no need for visa stamping.

You may also consult your new employer’s immigration lawyer and ask them.

Thanks for the response…our attorney insist that I need to go to stamping as mine got approved for consular processing…somewhere I wish there should be some kind of rule book that covers all the scenarios…so that there won’t be any speculations…

If you are outside of usa and received new H1B approval from new company, your previous petition is null and void.
Look at the validy dates on your new approved visa, that explains everything. Any visa you have before that validity date is automatically on no use, unless its B1 and B2 on your passport.
