H1B Application in process but I am yet to graduate

Hi,

I am undergrad student with F1 status.

I will be graduating in Mid June 2020

I have accepted the job offer and my starts date is Aug 2020

My employer wants to file H1B petition on my behalf for year 2021

My query is –

Will my H1B application be considered as I will graduating only in “Mid June 2020”

Will there be any effect to my post completion OPT which will be submitted in Mid March 2020 and will take sweet 3-4 months.

Please guide.

You need to submit the copy of degree or proof that you are done with bachelors by the time you submit your application. The 90 days timeline starts from April 1st. You technically can file with degree by end of June. I suggest you talk to your attorney on this, if the timing works out or not…Do update on how it all goes.

I have query for you, pls help.

In case I am selected in H1B lottery(touch wood) and petition is approved under consular notification, can I do stamping of H1B visa at my home consulate after a year as I am able to work and my status as F1 will not be effected being on OPT/STEM Ext. for next 2- 2.5 year
I mean is approved H1B petition is good to be used after 1 year of approval…

Yes, that’s possible. There is no time as such. Make sure you work for the same employer so that you have an answer to say when they ask you at home during stamping.
