My H1B Visa & I94 has been expired on Sep30th 2020 and my extension has been filled with USCIS on Sep’03 2020 and received my extension receipt notice on Oct’2020. Now my project has been closed and i have got a new project, When i reached my company’s immigration team, they are saying that they will not file amendment while extension is in progress.
Can someone please clarify whether H1B amendment can be filled on expired i-94 & Visa ?
No, they may not file an amendment when the current one is not approved. The main reason is you do not have status anymore and you are in something called as period of authorized stay.
You can ask them to upgrade to premium and then do this after the approval. Read below
