H1b Amendment got denied "Violation of law"

Urgent:----

I came to usa on F1 status in 2014 year and I got my first h1b approved from x company valid from oct 2016 - oct 2019. In 2017 my project x had been completed on march 31st 2017.

Immediately I found Y client in may month and started working.

I asked my employer to file lca and amendment asap after getting Y client. I didnt get proper response from my employer but he did my amendment in august month 2017. Later I got an rfe and it went to denial.

In denial notice uscis mentioned your presence is violation of law.

Please suggest me

  1. I have decided to go back to india but do i still come under cap exempt

  2. Better to get new petition with same employer or new employer while going to visa without any issues?

  1. Yes, you can reapply through cap exempt

  2. Better to have a solid client and project details when you go for the next interview I would say, than the employer.

Any suggestions

  1. I got job recently in April 2018, client is requesting me to join immediately within 2 weeks. They don’t know that I’m in India so I requested them for the client letter in order to file petition with my employer after the interview. But they are saying we can provide you the client letter only on the first week after your the joining at the client location.
  2. I told to my client n vendor that i’m in India, so they kept my position on hold. I struggled a lot to get this position, without client letter none of the employer is sponsoring my h1 including my current employer. Do you have any idea who can sponsor me at this situation either by doing in house projects etc. What are chances of getting petition and visa stamping approval by doing like this.

One of my friends is having the same problem like you, her h1b amendment got denied with violation of law due to the late filing in amendment date.

Can we go to the visa with previous approved petition which is valid thru 2020 or do we need to file the petition again?
