I am currently employed full-time with [Company X] and based in California. My H1B visa extension was filed three months ago for my present role and client in the Life Sciences domain. Unfortunately, my current project is ending in early November.
I have received an offer for a new project; however, since my H1B extension is still in progress, I am unable to initiate an amendment for the new assignment. My employer has advised that I return to India, wait for the visa extension to be approved, and then file an amendment for the new client before returning to the U.S.
In this situation, when my employer files the amendment, will they be required to pay the $100K fee again?
Also, could you please suggest if there are any alternative options to avoid travel or minimize disruption?
