H1B 240 days rule with RFE

Hi Raghu,

My wife’s H1B is under extension and 240 days will be over in April 2019 first week, But starting February employer upgrade the process to premium processing and on 2nd of February we got RFE. Now I am trying to understand that is my 240 days clock will still be counting or It is stopped until we reply to the RFE and resume once RFE response received by USCIS?

In general, as far as I know the 240 clock would continue irrespective of RFE. You can check with your attorney. If you have already upgraded to Premium, then submit the RFE response soon, you will get a decision soon… Check more info on H1B 240 Day rule
