Can you please let me know whether I am cap exempt for H1B 2022 visa. When I was working for Employer A they filed my I-140 and it got approved on May 1 2018. I came back to India in May 2019 and I left my job with Employer A in July 2019 which is when I joined Employer B. I am still working with Employer B in India. I read somewhere on internet that if a person stays with an employer who filed their I-140 for more than six months after I-140 is approved then the employer can’t revoke the I-140. Kindly let me know my eligibility for cap exempt for H1B 2022 visa, can Employer B file it for me.
