H1 Visa transfer Gap in companies

Hi Saurabh,

I am working for employer A and having valid H1 till Mar 2014(I94 is also valid till same date). I am transfering my H1 to company B.

  1. I have resigned in comp A on 10th June and they are releasing me on 14th June.

  2. My LCA transfer is in progress. After that they will file petition for transfer. We can expect receipt latest by 24 June

  3. Seems like I will be out of status for 10 days. Is that accepted?

When do you plan to join B? The earliest you can join them is when USCIS receives the cap-exempt petition.

Few days break b/w jobs is ok as one could be relocating or taking a break/vacation.
