Hi, I was in US on L1 B visa for 4 years and then converted to H1B. Stayed for 2 yrs in H1B before i moved back to India. It’s be 5 years since i came to India. Can you please confirm if i am eligible H1 non cap or if I have to raise H1 via quota as I already stayed for 6 years in US?
You will need to go for cap-subject/lottery if you already completed total time of 6 years on L1B & H1B ( L1B time will be counted against H1B) combined in past unless you have approved I-140 under which you can file AC21 H1B extension beyond 6 years under cap-exempt.
