H1 is in process,in US on h4??

Hi,

My h1 regular application is selected in lottery and is in process(applied when i am in india so w/o i94) and i entered US last week on h4 which is valid till sep 30 2013.

My question is if i h1 is approved in july or aug,can i work from oct or shall i need to apply for COS from h4 to h1 to get h1 i 94???If i need to apply for COS how long will it take and is there any premium process for COS??

You need to do either of 2 things:

  1. Have COS filed and start working on H-1 from COS approval date (not before that). There is no PP service just for the COS and typical processing time is 2-3 months.

  2. Go out of US, get H-1 visa stamped and enter on that visa to work on H-1.
