I am eligible for cap-exempt H1 for 3 years since I worked for only 3 years on H1 and returned this year. I got admission to a Masters Program and will be applying for F1. Am I eligible to use the 3 cap-exempt years after OPT?

Yes. As you had H1B status in US in the past, you are eligible for cap exempt H1B transfer. You can apply after F1 study for the same.

Thanks. Would you know the validity of the cap-exempt H1. Should I apply within 6 years of Previous H1 Expiry or within 6 years of date of denial of H1 Extension?

Usually, it is within 6 years from the previous H1B expiry…But again, this is slightly grey area…
