H1-B visa stamping - information about 221 G

Hi Saurabh - My wife’s H1-b petition has been approved. She works in the UK and plans to have her visa stamped sometime in July. Her assignment in the UK ends on August 31. My 2 questions are -

  1. If she gets a 221-G from the US consulate in UK, can she continue the stamping/responding process in India? That is because she has to leave UK by September 1 at the latest.

  2. If she gets a 221-G from the US consulate in UK, can she come to the US on L-2 and then do a COS to H1 sometime in the first week of September, while the 221-G is still issued?

  3. Generally, what would your suggestion be, go for a visa stamping OR try COS keeping in mind that her employer is a small consulting firm.

  1. Yes, she can ask consulate in UK to withdraw the case and re-appear in India. I don’t think they can transfer the case from UK to IN.

  3. COS is easier than stamping (at least in India). I don’t know about the strictness of US consulate in UK.
