H1-B transfer while in India - after staying 18 month in USA

I worked for Company A in US on H-1B status for 18 months. and then return back to India. I have H-1B VISA till September 2014 .now I got a good offer from Company B. i want to ransfer my VISA to Company B(USA).

  1. is it possible to transfer my VISA to Company B while I am in India

  2. do I need to go for stamping again after H-1B transfer petition approval

  3. is Company A( Current) cancel my VISA stamp and petition.

  4. if I resign ,can Company A( Current) cancel my VISA stamp and petition.

  5. if Company A do not cancel my VISA stamp, can I use it to travel back to US with Company B petition and Company A VISA stamp.

  6. after cancellation of my Petition by Company A, can I transfer my VISA to Company B. or I do I need to transfer before cancellation?

  2. IMO, you don’t need another stamping but check w/ your H-1 attorney on this

  3. Yes, they can do that. You can still go for cap-exmept petition, but would definitely need a new visa stamp if the old one is canceled.
