Hi , my H1 B visa was approved, which will be effective from Oct 1 2022, but I am laid off and I have got two weeks notice from my employer. I got a potential new employer who may be willing to file a transfer but since my H1 is not active what happens in this case ?
Transfer can only be applied once your H1B status starts. New employer may file cap-exempt H1B but it is up to USCIS as they may or may not approve it because technically your H1B has not been activated yet.
